Howard Moyer, foreman at the Bingham Mine, was arrested Friday by Constable U. S. Jennings on a charge of assault with a deadly weapon. When arraigned before Justice H. M. Eichols, he pleaded not guilty and his preliminary hearing was set for 2 o'clock Wednesday afternoon. He was released under $250 bond. Complaint against Moyer was filed by J. F. Swafford, who said Moyer drew a gun on him during an argument over a settlement relative to ore Swafford said he had mined at the Bingham Mine, in the southeast part of town, Moyer is supervising a group of men who are "high-grading" on the property. He said he drew the gun in self-defense because Swafford threatened to strike him with a rock.
