23 years old, one of the nine victims of gunshot wounds Apr 11, at Galena Kansas, when Blue Card union men paraded down Galena's Main Street, died at 3 am today in a Joplin Missouri hospital. Death followed an attack of pneumonia. Miller, who was wounded in the neck and head by shots allegedly fired from with the International Union of Mine Mill and Smelter workers' headquarters, was an employee of the New Deal Mine. He had lived at Picher Oklahoma recently, moving to that city several weeks ago from Wichita Falls Texas. The other eight victims of the Galena shooting, including a 15 year old boy, have all shown improvement. Virgil Darnell, also of Picher, and reported at first as being the most seriously wounded is continuing to improve at a Joplin hospital, it was reported this morning. Joe Henbest, county attorney of Cherokee county Kansas, was in Topeka Kansas, today and could not be reached for a statement relative to any filing of additional charges as a result of the death. Sheriff Fred Simpkin told the News Record by telephone that Kansas authorities could not hold an inquest into the death, since Miller died in Joplin. Any further investigation would have to be made there. The Associated Press quoted assistant county attorney A. L. Majors as saying late this afternoon that murder charges were being considered. Eleven men, who allegedly fired guns from within the International union headquarters the day of the Blue Card union's parade, are now charged with assault with deadly weapons with intent to kill. They are cited in a blanket complaint. One Cherokee county official, who refused to be quoted, said he did not know whether charges would be altered, but said he believed when county attorney Henbest returns tonight from the Kansas capital an immediate investigation will be held. It was indicated in reports circulated at Columbus Kansas that the present charges, which constitute a felon, may be changed to include more serious allegations. None of the 11 cited in the blanket complaint has been specifically charged with wounding of any particular victim. Funeral arrangements were incomplete for Miller.
