49 years old, was in a critical condition today at the American hospital, Picher Oklahoma, a bullet wound in his right lung, and Henry Smith, 60, his father-in-law, was a county prisoner, as a result of a shooting early Sunday morning at Smith's home at Monarch Kansas, two miles northwest of Picher. Smith told police, to whom he surrendered following the shooting, that he acted in self defense. McKinney [two spellings in paper], who has been employed as a powder man at the Wilbur Mine, was said to have been intoxicated when he reached home Saturday night. McKinney and his wife, live in a house owned by Smith, adjoining the latter's home. Mrs. McKinney said her husband beat her and then brandished a razor, threatening to kill her. The woman's screams attracted the attention of her father, according to Smith, and he called to her to come to his house. She ran to the adjoining house. About 1 o'clock, shortly after she had sought refuge with her father, Smith told police there was a knock at the door. Smith said he opened the door and McKinney rushed at him with a razor. Smith had armed himself with a .38 caliber revolver and he shot twice, he told police. McKinney fell and Smith called an ambulance from the Green undertaking company, Picher. After accompanying McKinney to the hospital, Smith went to police headquarters and surrendered. One bullet entered McKinney's right side, piercing the lung. The other took effect in his left leg. Police expected to transfer Smith to the county jail at Miami today. He was in the city jail this morning. Smith has been working as a pump man at what is known as the old Gordon Mine, operated by the Federal Mining and Smelting Company.

Improvement is reported in the condition of Frank McKinney, 49 years old, who early Sunday morning was wounded by his father-in-law, Henry Smith, 60, at the latter's home in Monarch, two miles northwest of Picher. Smith, who surrendered to Picher authorities following the shooting, is being held at the county jail pending the outcome of an investigation. Smith insists he shot his son-in-law in self-defense.
