R. D. Yost, a driller, was named defendant in a suit for $25,000 damages, filed late Friday afternoon in district, court by Frank Sims, administrator of the estate of Roy Sims, 19 years old, who died April 12 from injuries alleged to have been received July 23, 1924, while he was acting as a drill man's helper in Yost's employ. The petition sets forth that young Sims became affected with sarcoma as a result of injuries received to his right knee when struck by an iron wrench. The leg was amputated, but the amputation failed to save Sims' life and he died a few weeks ago. The petition charges Yost with "carelessness and negligence."
A jury in the Ottawa county Oklahoma district court at Miami late Monday awarded Frank Sims judgment of $1,800 against R. D. Yost, drilling contractor. Sims, father of Roy Sims, 19 years old, who died April 12, 1925, from injuries received July 23, 1924, while in the employ of Yost as a drill man's helper, sued for $2,100 for loss of the son's earning until the youth would have become of age. The verdict was returned shortly before 6 o'clock, ending a long case. Hearing of the suit was begun last Friday. The court recessed over Saturday and Sunday and the case was resumed Monday morning.
