Accidental death, due to a falling slab was the verdict of a coroner's jury last night which investigated the death of Emery L. Proctor, 25 years old, who was crushed in a drift of the Isherwood Mine at Smithfield yesterday morning. Earl Hostetter, who resides on the Webb City Missouri road, a fellow shoveler, who was with Proctor when he was killed, the ground foreman and roof man of the mine testified at the inquest, conducted by Coroner R. M. Stormont in the city hall at Carl Junction Missouri.

Beecher McCoy, of Oronogo Missouri, roof trimmer, had gone into the drift shortly before the mishap and asked Proctor and Hostetter, who were shoveling, about the condition of the roof. They pointed out a place where there seemed to be some loose dirt, and he went back to the front of the drift to get a bar. As he was returning and when he was within about fifty feet of Proctor, a portion of the roof gave way without warning and Proctor was crushed beneath the falling slab and rock. He was killed almost instantly. Testimony was given at the inquest that the roof had been in good condition. Proctor's body was taken to the Hurlbut undertaking company.

Surviving Proctor, who resided northwest of Thomas Station, are his widow, Mrs. Jessie Proctor, four sons, Charles Proctor, Earl Proctor, Johnnie Proctor and Robert Proctor; his parents, Mr. and Mrs. W. S. Proctor, who live northwest of Thoms station; two brothers, Albert Proctor, at home and William Proctor of Belville, and a sister, Mrs. Mamie Burton of Greene Valley Illinois. Funeral arrangements are incomplete. The Isherwood Mine is owned by the Kansas Explorations Company.
