the body of a man was discovered in a ditch on North Connell avenue, Picher Okla. It was an accidental death when he fell from his bicycle and struck his head on a rock. Smith's body was found face down next to a culvert at about 10:20 am Saturday by a passerby in the 200 block of North Connell. Smith of 608 North Emily street apparently died the night before after leaving a Picher bar at approximately 8 pm. Investigators did not suspect foul play. "He was probably intoxicated and got onto his bicycle to ride home and fell into the ditch." Smith, a mechanic at Bingham Sand and Gravel in Treece Kansas, died about a half-mile from his residence.

James Allen Bear was indicted by a federal grand jury in Tulsa on charges he twice broke into a mobile home belonging to Dewey Smith who was found dead in a roadside ditch Sep 13, 2003. Bear broke into the mobile home on Sep 18th and Sep 19, 2003, and set fire to the mobile home Sep 19th. Bear is also charged with breaking into the mobile home in June of 2003.
