age 82, of Commerce Oklahoma, died in the Miami Baptist hospital Tuesday afternoon an hour after she was hit by a car while crossing a street in the business district of Commerce. Mrs. Terry had lived in Commerce for many years and was an active member of the Baptist church, where she taught a junior Sunday school class. An Army nurse, Mrs. Marjorie Elaine Ball, 30, was driving the car which struck Mrs. Terry at the intersection of Commerce and Vine streets.
Accompanying Mrs. Ball was her husband, Capt. Prentiss E. Ball. both are stationed at Brooks General hospital, Fort Sam Houston Texas and were en route there after vising in Massachusetts. The driver told Highway Patrolman Garland Peek that the aged victim appeared to have stopped in the middle of the street to allow traffic to pass. Mrs. Ball was quoted as saying the Commerce resident stepped in front of her 1950 Austin unexpectedly. Knocked to the pavement by the left front bumper of the vehicle, Mrs. Terry was rushed to the hospital where she succumbed at 3:15 o'clock, an hour after she was injured.
In Miami this morning a suit for $2,999 against the Balls was filed on behalf of three daughters of the deceased, Mrs. Harry Walker of Commerce, Mrs. Nell Eppinger of Gillespie Illinois and Mrs. Frank stele, Joplin. The petition alleges the accident was caused by negligence on the part of the defendants. The $2,999 sought includes $1,000 for anticipated funeral expenses and $150 for medical, hospital and ambulance costs. The accused couple was expected to make surety bond later today before continuing on to Fort Sam Houston.
Besides the daughters, Mrs. Terry also is survived by a step-son John Sherwin of Independence Kansas; a sister, Mrs. Ella Witt, Plainville Illinois; nine grandchildren and 14 great grandchildren. Funeral arrangements will be announced by the Mitchelson funeral home of Commerce.
